Terms of Service

1. Agreement to Terms

By accessing or using the LOA application and website at showloa.com ("Service"), operated by Selah Bekk LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

LOA is a subscription-based software-as-a-service (SaaS) platform that enables subscribers to:

• Create personalized profiles for recipients (family members, friends, loved ones)
• Generate AI-assisted encouraging messages tailored to each recipient
• Deliver messages via SMS, email, or in-app notification
• Order printed message sets for physical delivery

3. Eligibility

You must be at least 18 years of age to create an account and subscribe to the Service. By using LOA you represent and warrant that you meet this requirement. If you are adding a minor as a recipient, you represent that you have the legal authority to do so.

4. Account Registration

To use LOA you must create an account by providing accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use at hello@showloa.com

We reserve the right to terminate accounts that violate these Terms.

5. Subscription and Payment

Subscription plans:

LOA is offered on a subscription basis. Current pricing is available at showloa.com. Plans may include monthly or annual billing options.

Payment processing:

All payments are processed securely through Stripe. By subscribing you authorize us to charge your payment method on a recurring basis according to your selected plan.

Cancellation:

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods.

Price changes:

We reserve the right to modify pricing with at least 30 days notice to active subscribers.

6. SMS Messaging Terms

By using LOA's SMS delivery feature you agree to the following:

• You represent that you have obtained or will obtain the consent of each recipient before their phone number is added to your account
• LOA will send an initial opt-in confirmation message to each recipient before delivering any subscriber messages
• Recipients must reply YES to confirm consent before receiving messages
• Message and data rates may apply to recipients
• Recipients may opt out at any time by replying STOP
• Recipients may request help by replying HELP
• You will not use LOA to send harassing, threatening, or inappropriate messages
• Violation of SMS messaging terms may result in immediate account termination

7. Acceptable Use

You agree not to use LOA to:

• Send harassing, threatening, abusive, or harmful messages
• Impersonate any person or entity
• Send unsolicited commercial messages or spam
• Violate any applicable law or regulation
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to our systems
• Use the Service for any purpose other than its intended personal encouragement use

We reserve the right to suspend or terminate your account for any violation of these terms without refund.

8. Content and Messages

Your content:

You retain ownership of the messages you create through LOA. By using the Service you grant us a limited license to store, process, and transmit your content solely for the purpose of delivering the Service.

AI-generated content:

LOA uses artificial intelligence to assist in generating message suggestions. You are responsible for reviewing and approving all messages before they are sent. We do not guarantee the accuracy, appropriateness, or suitability of AI-generated content for your specific situation.

Prohibited content:

You may not send messages that are harassing, threatening, sexually explicit, discriminatory, or otherwise harmful or illegal.

Bible verses and quotes:

LOA may include public domain Bible verses (KJV translation) and properly attributed public domain quotes as message elements. We do not reproduce copyrighted song lyrics or other protected content.

9. Intellectual Property

The LOA name, logo, application, website, and all associated content are the property of Selah Bekk LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

The font "Shadows Into Light Two" used in our branding is licensed under the SIL Open Font License.

10. Privacy

Your use of LOA is also governed by our Privacy Policy, available at showloa.com/privacy, which is incorporated into these Terms by reference.

11. Third-Party Services

LOA integrates with third-party services including Stripe (payments), Twilio (SMS), Supabase (database), and Anthropic (AI). Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

LOA is an encouragement platform and is not a substitute for professional mental health, medical, or counseling services.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELAH BEKK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Selah Bekk LLC, its members, officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Arkansas, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Washington County, Arkansas.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

17. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination you may request export of your data within 30 days.
